Terms of Service

By accessing the Site — whether as a guest or as a registered user — you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are using the Site on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

I may update these Terms at any time by posting a revised version with an updated “Last updated” date. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

I grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use — specifically for the purpose of evaluating real estate for a potential purchase, sale, or financing decision. This license does not include:

• Reselling, sublicensing, or commercially exploiting any content from the Site.
• Reproducing, copying, or distributing any listing data, valuation estimates, or other MLS content obtained from the Site.
• Using automated tools (bots, scrapers, crawlers, or similar) to collect content from the Site.
• Framing, deep-linking, or embedding Site content on any third-party website without my written consent.

I reserve all rights not expressly granted in these Terms.

Property listings displayed on this Site are sourced from the REALTOR® Association of Acadiana (RAA) MLS via an IDX (Internet Data Exchange) data feed licensed to me as a Participant. By accessing listing data on this Site, you agree to the following:

• Personal use only. Listing information is provided exclusively for your personal, non-commercial use in identifying prospective properties you may be interested in purchasing or selling.
• No redistribution. You may not copy, redistribute, retransmit, publish, or otherwise share listing data from this Site, except as strictly necessary for your own transaction (e.g., forwarding a single listing to your lender).
• RAA copyright. All listing data is and remains the intellectual property of the REALTOR® Association of Acadiana and its Participants. Nothing in your use of this Site conveys any ownership rights in MLS data.
• Accuracy not guaranteed. Listing information is believed to be accurate but is not guaranteed. All listing data is subject to change without notice. You should independently verify all information before relying on it.
• Audit rights. RAA and its authorized representatives may audit use of this Site to verify compliance with IDX rules.

These requirements are mandated by my data license with RAA and by the Spark Platform Developer Agreement governing the IDX data feed.

Access to the automated home valuation (AVM) feature is provided under the RAA Participant Data Access Agreement, Exhibit B, and is subject to additional terms you must accept before your first use. A summary of those terms is provided here; the binding click-through agreement presented in the tool controls:

• You must have a verified email address and acknowledge a broker-consumer relationship with me before accessing any AVM estimate.
• AVM estimates are derived from RAA MLS data and are provided for your internal use only. You may not disseminate, publish, or reproduce AVM results without RAA's permission.
• AVM estimates are mathematical models and are not appraisals. They are not a substitute for a formal appraisal, comparative market analysis, or professional real estate advice.
• The REALTOR® Association of Acadiana retains copyright in the underlying data. By using the AVM tool you acknowledge RAA's ownership and the validity of its copyright.
• RAA and its representatives may access the AVM tool to verify compliance with RAA Policies.

Certain features of the Site (saved searches, favorites, home valuation) require you to register with a valid email address. Authentication is handled via a magic-link email. You are responsible for:

• Keeping your email account secure, since it is the key to your account.
• All activity that occurs under your account.
• Notifying me promptly at jeanne@declouet.com if you suspect unauthorized access.

I reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to the Site, other users, or third parties.

You agree not to use the Site to:

• Violate any applicable federal, state, or local law or regulation.
• Harass, threaten, defame, or harm any other person.
• Submit false or misleading contact information or inquiries.
• Interfere with the security or integrity of the Site or its underlying infrastructure.
• Attempt to gain unauthorized access to any part of the Site, its servers, or any third-party systems connected to it.
• Transmit viruses, malware, or other harmful code.
• Engage in scraping, harvesting, or automated collection of any content — including listing data, contact information, or pricing data.
• Use MLS data in a manner inconsistent with the IDX terms in Section 3 above.

Except for MLS listing data (which is owned by RAA as described in Section 3), all original content on this Site — including text, design, graphics, logos, and code — is my property or is used under license. The NextHome brand, logos, and mascot are property of NextHome, Inc. and are used here under affiliation guidelines.

You may not reproduce, modify, distribute, or create derivative works from any original Site content without my prior written consent.

The Site integrates third-party services including Google Maps, Amazon Web Services (for email delivery), and the Spark Platform (for MLS data). Your use of those services is subject to their respective terms and privacy policies. I am not responsible for the practices of any third-party service provider.

The Site may contain links to third-party websites. Those links are provided for convenience only. I do not endorse and am not responsible for the content, privacy practices, or terms of any linked third-party site.

Financial Business Systems, Inc. (FBS) and the REALTOR® Association of Acadiana are not responsible for providing support for this Site. For support, contact me directly at jeanne@declouet.com.

When you submit a contact form on this Site, you may optionally select “Text” as your preferred contact method. If you do, a separate SMS consent checkbox is displayed. By checking that box you agree to the following:

• You consent to receive text messages from Jeanne de Clouet related to your real estate inquiry at the phone number you provide.
• Message and data rates may apply based on your mobile carrier and plan.
• You may opt out at any time by replying STOP to any text message or by contacting me at jeanne@declouet.com.
• Text messaging is an optional, additional contact channel. You are never required to consent to text messages to use this Site or to receive real estate services.
• Your phone number will not be shared with third parties for marketing purposes.
• Text messages sent through this service are for real estate inquiry follow-up only — not for bulk marketing. The frequency of messages depends on your inquiry and response.

This site and all content — including listing data, valuation estimates, market statistics, and neighborhood information — are provided “as is” and “as available” without warranties of any kind, either express or implied.

I do not warrant that the Site will be uninterrupted or error-free, that any listing data is current or accurate, or that any valuation estimate reflects actual market value. Listing information is supplied by third parties (RAA MLS) and is not independently verified by me. You should conduct your own due diligence before making any real estate decision.

Nothing on this Site constitutes legal, financial, tax, or investment advice.

To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, this site or its content — including listing data or valuation estimates — even if advised of the possibility of such damages.

My total liability to you for any claim arising from your use of this Site shall not exceed one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

You agree to indemnify, defend, and hold me harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any third-party right, including intellectual property rights or privacy rights.

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or your use of the Site that is not resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in Lafayette, Louisiana, and you consent to personal jurisdiction in those courts.

Before initiating any formal proceeding, you agree to contact me at jeanne@declouet.com and attempt to resolve the dispute informally for at least 30 days.

I may suspend or terminate your access to the Site at any time, with or without notice, for conduct that I believe violates these Terms or is harmful to other users, third parties, or the Site. Upon termination, the provisions of these Terms that by their nature should survive (including Sections 3, 7, 9, 10, 11, and 12) will continue to apply.
